Fremont Mayor Bob Wasserman dies

Fremont Mayor Bob Wasserman ? who tried to bring the Oakland A?s baseball team to his city and keep the NUMMI auto plant from closing ? died Friday at the age of 77, according to city officials.

Wasserman died at the Kaiser facility in Fremont in the presence of his family, city officials said.

Wasserman had been active in Fremont government since 1976, when he was appointed to be the city?s chief of police.

After retiring from a 40-year career in law enforcement that included appointments in Southern California and a term as the president of California Peace Officers? Association, Wasserman was elected to the Fremont City Council in 1992 and had served as mayor since 2004.

City officials said he had previously been commended for outstanding public service by a resolution of the California Senate and received the Law Enforcement Executive of the Year Award.

Vice Mayor Anu Natarajan said in a statement, ?Mayor Wasserman served the residents of Fremont for 35 years with distinction and dedication. On behalf of the City Council, I offer heartfelt condolences to the Wasserman family.?

Natarajan will fulfill the duties of mayor until the City Council decides on how to fill the remainder of Wasserman?s term.

Wasserman is survived by his wife of 53 years, Linda, and their two children, Dan and Jill.

Funeral arrangements are pending.

Wasserman supported efforts by A?s owner Lew Wolff to build a baseball stadium in Fremont so Wolff could move the team there and was disappointed when Wolff said on Feb. 24, 2009, that he would stop those efforts in the face of strong opposition by neighborhood groups.

Reacting to Wolff?s announcement, Wasserman said, ?We?re missing the best opportunity we ever had and I?m very saddened by it.?

Wolff is currently working on trying to move the team to San Jose but hasn?t received approval to do so from Major League Baseball.

Wasserman also sought to keep the New United Motor Manufacturing Inc. plant in Fremont, which was a joint venture of Toyota Motors Co, and General Motors, from closing but the plant was ultimately shut down on April 1, 2010.

Since then, Wasserman has supported efforts to find other uses for the large facility, including Tesla Motors? use of part of the land to build a premium electric sedan called the Model S.

Lady Gaga's ex-assistant sues her for $400K

Has Lady Gaga been keeping too tight of a hold on her meat-purse strings?

The pop superstar's former assistant claims she's owed nearly $400,000 in overtime pay after attending to Gaga's every need for four weeks in 2009 and then throughout 2010 and into March of this year.

The plaintiff claims she worked 7,168 hours of overtime during her period of employment, meaning she was basically on duty almost every hour of every day that she worked for the "Born This Way" artist. Her complaint states that she was paid $1,000 per week for her time in 2009 and then an annual salary of $75,000 for the rest.

But that's just base salary, according to the suit, and does not account for the time O'Neill spent attending to Gaga business "not only in her home, but also during her travels to her global concert tours, from city to city throughout the world, at locales including stadiums, private jets, fine hotel suites, yachts, ferries, trains and tour buses."

O'Neill "was always behind the scenes, and figuratively, if not literally, always at her side," the suit states.

"Jennifer O'Neill's lawsuit is completely without merit," a rep for Gaga tells E! News of the suit, filed Dec. 14 in U.S. District Court in New York.

The top 10 tech stories of 2011

Whew! Good ol' 2011 is almost over and that means that we're gonna take a little break from tech news and relax until the spring.

Just kidding! What the end of the year really means is that we're getting a bit sentimental and reviewing the top tech stories of the last 365 days. Here are the 10 which stood out to us, in no particular order.

Apple

When Apple co-founder Steve Jobs?died on Oct. 5, at age 56, the loss resonated?throughout the tech world?in?unprecedented ways.?He was described as?our generation's Thomas Edison?and his legacy was celebrated accordingly.

The Internet mourned the passing of the man with over?2.5 million tweets?in the twelve hours following his death. People around the world sent?over one million emails?filled with wishes, memories and words of sympathy to an address set up by Apple.

Samsung and Google, some of the company's competitors, delayed the release of new products out of respect for the loss of the man who launched Apple.

As his eponymous biography by Walter Isaacson hit the shelves, we?dissected everything about Jobs from minutia ??such as his?final words, eating habits, reading list, workaholic nature?and?old pranks???to grand concepts such as?his life's work. (It is worth noting that the Jobs biography became Amazon's best-selling book of 2011?and?Sony Pictures is said to be working on a movie version.)?

Lulzsec (R) and Anonymous (L)

What's any year without a couple of big security scares? In 2011, hacking groups Anonymous and Lulzsec were two entities that struck fear in a lot of network administrators' hearts.

Between the two groups?? who even teamed up at one point???there was a great deal of trouble stirred up.

Lulzsec, a mysterious and loosely knit organization, took out (or at least claimed credit for affecting)?multiple gaming websites,?an?FBI website,?a porn site,?a?Senate website, a CIA website, Rupert Murdoch's Sun newspaper website?and more. The fun was over once the group's key member and spokesperson?? a fellow who goes by the name "Topiary"?? was nabbed by authorities in the U.K.

Anonymous on the other hand didn't suffer any similarly large casualties or stumbling points while taking credit for?sharing thousands of military email addresses, taking down a tourist-oriented website in Orlando, Florida, hacking an FBI partner site, snatching files from servers belonging to large U.S.-based companies, conducting a DDoS attack on MasterCard, as well as some miscellaneous mischievous deeds.

Now?this all may sound?somewhat funny, but you should probably keep in mind that the individuals responsible for these events are heralding a world of heightened security and constant threats.

The many headaches suffered by RIM
This year made me want to hug Research in Motion's troubled executives. The folks over there just couldn't catch a break as one of the company's shiny new gadgets?? the BlackBerry Playbook?? got slammed in reviews, its share of the U.S. smartphone market shrunk?and its freshly launched music-sharing service was ridiculed.

And as if that's not enough, the company's sites were hacked after it offered to cooperate with U.K. authorities in order to research what?? if any?? role the BlackBerry Messenger service might've played in inciting riots in early August.

But hey, at least the company managed to squeak by with a decent quarter?(if you ignore millions of dollars worth of unsold BlackBerry Playbook tablets, that is).

How the Internet helped bring down a dictator
As much trouble as the Internet ??or rather, social media ??can cause, it can also do quite a bit of good at times. In 2011, we saw a great example of this phenomenon as?the Internet and social media played a pivotal role in a revolution.

What happened? Well, on Jan. 27, right before the Egyptian government pulled the plug on the country's Internetin order to quiet protestor activity, there was a great deal of traffic coming to social networks, Facebook in particular. What better place to get organized?than Mark Zuckerberg's playground, after all?

You'd think that the whole business of shutting down the Internet would've eliminated social media and the like from the big fight against the 30-year government of Hosni Mubarak, but Egyptians kept in touch with the outside world using a series of workarounds.

Anyway, long story short: When the Internet switch was flipped back on, Egyptian's were celebrating the end of Mubarak's rule and social media was praised for aiding a revolution.

Netflix

Netflix and its wacky business moves
A recent consumer study revealed that the satisfaction levels of Netflix customers have dropped?significantly and?? unless you've been sleeping under a rock with no Wi-Fi connection?? you shouldn't be surprised by that.

After all, the company alienated and angered a lot of folks when it announced that it would?no longer be offering a combined DVD and streaming plan and?would instead separate the services, for a minimum cost of about $16 a month if you still want both.

And as if people weren't riled up enough over that?? and boy, were they riled up!?? Netflix announced that it would split itself into two separate businesses, video-streaming company Netflix and DVD rental company Qwikster. No one truly understood?where that particular idea came from or why the heck Netflix didn't secure the @Qwikster Twitter username before announcing its plans.

None of that matters anymore though, because Netflix made our heads spin all the way around again by canceling the whole plan to split into two.

Apple

The release of the iPhone 5, er, 4S
Every year since 2007 has brought us a shiny new smartphone from Apple and 2011 was no different. The year marked the introduction of the iPhone 4S?? yes, it really wasn't called the iPhone 5?? and its built-in voice-activated personal assistant Siri.

After months of wildly inaccurate speculation?and a keynote sans Mr. Jobs, we stood in lines, whined about little technical hiccups, and found silly things to giggle over as soon as the device was released.

It's worth noting that the hardware?? the actual iPhone 4S itself?? wasn't really the big star this year. Instead iOS 5, the latest version of Apple's mobile operating system, made us swoon with all its new features.?

Google

The launch of Google+
There's no such thing as too many social networking services, right?

Well, at least Google didn't think so when it launched something called Google+.

The service?? which is finally open to everyone after a long period of being invitation-only?? is now unavoidable. It's?integrated into our Gmail accounts, has the obligatory mobile apps, keeps us busy with privacy issues that we can debate?and has some confusing labels that we still haven't entirely figured out. (What do you call adding a friend on Google+? I still maintain that "plussing" someone sounds slightly dirty.)

It's worth noting that despite the fact that Google+ is so darn difficult to avoid, interest in the social network appears to be waning?after initially rocketing when the service opened its doors to the general public.?

Google

Android's dominance
Even as the token Apple?? and iOS?? fangirl around here, I couldn't turn a blind eye to how Android's been doing this year. It seemed that not a day could pass before there was yet another study, survey, or other data set that listed Google's mobile platform as being the No. 1 something-or-other or the top thingamajig-of-some-sort.

Don't believe it? Alright, let's run down a couple of highlights.

Android is the No. 1 smartphone platform in the U.S. (based on market share), comes out on top of worldwide sales statistics, rules?about 50 percent of the global smartphone market, dominates the southern part of the U.S., has the biggest chunk of the mobile app download market, has more daily Facebook users than iPhone, it's the most popular mobile platform for malware, and may have nicer users than iOS.??

Oh, and in case you wanted more statistics: Nowadays over 700,000 new Android devices are supposedly activated each day. We don't really know if that earns Android another No. 1 trophy as Apple hasn't released any official numbers for comparison.

Facebook Timeline re-design (and Mark Zuckerberg's silly antics)
No end-of-the-year story round up would be complete without a mention of Facebook or its founder's antics. So let's hit on the big topics of the year?? aside from the usual privacy drama that always surrounds the social network.

In 2011 we were introduced to Timeline, a new Facebook profile design which naturally got us riled up. (Because we don't like change, darn it!) We didn't mind most of the new apps that were announced along with the redesign?though ? until we realized that the way they're integrated could lead to a lot of embarrassment?(and reveal our love of Justin Bieber songs).

Upset with Facebook's features and designs or not, we still aren't really managing to stay away from the social network. At least that's what a study suggested when it showed that we're all only about four degrees of separation apart on Facebook (rather than the six degrees assumed by the popular Kevin Bacon-themed game).

Facebook itself aside, many of us?? yours truly included?? were once again far more fascinated by the social network's founder than anything else. How could we not be when the man revealed that he is currently only eating animals which he kills and keeps?slipping us private photos thanks to technical glitches?

Apple

The release of the iPad 2
What? You think that one major Apple product release a year should be enough? Sorry, buddy?? but 2011 brought us the iPad 2 on top of the iPhone 4S.

The second generation tablet?? which was upgraded to iOS 5, the latest version of Apple's mobile operating system, months after its release?? is everything a shiny new toy should be: It's thinner, lighter, and more powerful than its predecessor.

We naturally waited in line for it, collected every detail we could while preparing for its release date, and hugged it tightly as soon as we picked it up. (Ok, maybe only I did that last part.)

All in all, we treated the release of the iPad 2 like any other major product release: With glee. But neither that behavior nor the actual iPad 2 itself were the big story this year. The gadget was such a darn big deal because it showed that the public finally grasped the notion of tablets, of life in a post-PC world.

The device topped holiday wish lists, was among the most searched terms on Google, earned the Consumer Reports seal of approval, sold out insanely quickly (and mostly to first-time iPad buyers), and kept selling despite constantly delayed shipping times. And if you prefer that in terms of hard statistics: Apple sold a whoppin' 11.12 million iPads during the fourth quarter of its fiscal year. (Yes, that's a lot??? an all-time record for iPad sales.) ?

Volkswagen tops the 10 best car ads of 2011

Yes, I know, this sounds like a roster of the best sushi-flavored ice creams.? The vast majority of car industry commercials are tripe, either falling in the category of my-truck-is-tougher-than-yours urination contests or bash-your-head-against-the-wall Sale-A-Brations trying to move metal for dubious ?holidays? like Christmas in July.? Others try too hard, inflicting dancing hamsters on us.

But occasionally lightning strikes and we get genius.? We?ve seen it before as with this 1996 Nissan commercial, Toys.

Not everything in this year?s top ten list reaches that level, but a few of them definitely equal the spark of Toys.

10.? Cadillac, "Pioneered by Cadillac and Used by Ferrari"

We all know that Cadillac makes cushy highway barges, right?? And Ferrari is the world?s preeminent sports car builder.? Got it?? Absolutely nothing in common. But Cadillac needs to remake its image for a new generation, and it is building the slinky CTS-V Coupe to get their attention.? Turns out some Cadillac know-how also got Ferrari?s attention, as the Prancing Horse has adopted electromagnetic adjustable shock absorbers first seen on the Plodding Hearse.? Definitely makes you scratch your head.? But don?t think of taking grandma?s ?98 Deville to the track.

9.? Audi, "Luxury Prison"

When your product is not the industry standard, you make a living by knocking the king off his throne.? Audi is gaining U.S. market share hand over fist at the expense of incumbents like Mercedes-Benz and Lexus by directly targeting them in ads that make them look fusty, dull or, worst of all, common.

The Luxury Prison commercial was produced for the Super Bowl, and it paints Mercedes-Benz drivers as moldy old followers, bound to choose their car because ?my father had one.?? Meanwhile the younger, hipper protagonist escapes Luxury Prison in his trendy new Audi A8.

Best of all, the stuffy traditionalists rioting in Luxury Prison are pacified by the dulcet notes of noted jazz saxophonist Kenny G, who demonstrates an unexpected sense of humor by participating in this commercial and the lengthy internet teaser which preceded it.

Honorable mention to another Audi commercial featuring former NBA basketball coach Phil Jackson.

8.? Chevrolet, "Corvette ZR1 Racing Porsche, Ferrari and BMW" ?????????

When car companies go racing, they have to soup up their production models to levels unimaginable to the assembly line workers bolting the cars together.? Unless the race car in question is a supercharged 638 horsepower, 205-mile per hour Corvette ZR1, in which case the racing rulesmakers insist they rein it in.

As Chevrolet fights its way back from General Motors? bankruptcy, it needs spots to convince people that it can compete with the world?s best car brands and win.? On the racetrack it can do that with one arm, and about 168 horsepower, tied behind its back, which sounds like a good start.

The flag-waving Still Building Rockets spot is another good one, reminding us that American ingenuity is alive and well.

7.? Porsche, "Engineered for Magic"

Porsche, in contrast to Chevrolet, has established its performance bona fides, but seeks to convince shoppers that its cars aren?t limited to the racetrack.? The "Engineered for Magic" spot shows the company?s famous sports cars serving in prosaic chores like driving in snow, hauling concrete from the hardware store and picking up kids from school.? Like the Cadillac commercial, it works for Porsche because it plays against type, and who doesn?t like the idea of rationalizing the purchase of a news sports car because it is practical?? You just better hope those kids don?t grow if you want to keep putting them in the back seat.

6. Fiat, "Seduction"

Fiat plays to type with this commercial for the Abarth high-performance model of the 500 minicar.? Italian performance is sexy, sultry and even seductive.? Our everyman hero is bopping along, minding his own business when he is ensnared by irresistible Italian sex appeal, which turns out to be generated by a car.? The spot is also helpful for Fiat in its attempt to reenter the U.S. market because the 500 has been struggling with an apparent ?girl car? label, and the sporty Abarth and car-as-a-girl portrayal should shore up interest among male buyers.? It is certainly more powerful than the pointless Jennifer Lopez commercials for the 500, which seem more like an attempt to kickstart her career than to tout the fun little Italian runabout.

4 (tie).? Chevrolet, "Volt Gas Station 1 and 2"

The next two commercials involve a bit of corporate sniping at one another, so to avoid being caught in their crossfire or accused of favoritism, we?ll call it a tie between Nissan?s battery-electric Leaf, which uses no gas and and Chevy?s extended-range battery electric Volt, which can use some gas.? In alphabetical order, the Chevy is listed first.

Because the idea of a gas-powered electric car is confusing to most consumers, Chevy tries to explain it by having a kid pester a Volt driver who has stopped at a gas station to answer nature?s call, not OPEC?s.? See, this electric car can use gas, but only if your need too, after running low on electrons, so that, well, watch the spot?s explanation.

4 (tie).? Nissan, "Gas Powered Everything"

There is a disturbing dystopian edge to this commercial, but it certainly grabs your attention.? In an effort to shoot down the idea that the Volt?s ability to burn gas is an advantage, "Gas Powered Everything" imagines a world in which, well, everything, is gas powered.

From the tiny screaming two-stroke-powered iPods to the industrial chug of the tractor motor in the copier, this world is grease-smeared and polluted, illustrating the expected benefits of shiny, happy electric power.

The pump of the gas pedal and twist of the key is familiar to anyone who has ever driven a gas-powered car, especially one old enough to have a carburetor.? The exposed valvetrain of the antique engine powering the coffee maker lends a real steampunk aesthetic for appreciative gearheads.? Calling it ?darkly memorable,? AdWeek magazine named it the ninth-best commercial of 2011.

3. Volkswagen, "Vamanos"

It is like a set-up for a Johnny Carson joke on the pre-Leno Tonight Show.? ?My Passat TDI can go so far on a tank of gas.?? ?How far can it go?? It turns out, according to this commercial, that after 13 hours and nearly 800 miles in the saddle listening to a Learn to Speak Spanish CD, two white-bread buddies on a road trip can emerge from the Passat at a gas station arguing in Spanish.? That?s how far it can go on a tank of gas.? Er, diesel.

2. Chrysler, "Born of Fire"

But for Volkswagen?s tour de force, Chrysler?s ?Born of Fire? paean to the motor city featuring the real Slim Shady/Eminem/Marshall Mathers and the Selected of God gospel choir would have stolen the show in the Super Bowl commercial sweepstakes.? As it is, it dominated the ?Best Drama? category, illustrating the real people who still live in Detroit and who remain dedicated to the city?s success even while coastal elites have long since written off Motown, its residents and their products. ?Edmunds.com says that search traffic for Chrysler jumped 328 percent after the spot and AdWeek named it the third-best commercial of 2011.?

The Chrysler-sponsored Selected of God video of their version of Eminem?s ?Lose Yourself? is even more musically compelling.???????????

1. Volkswagen, "The Force"

Sometimes a baseball slugger hits a pitch so perfectly that he knows from the feel of the bat, before the ball has even gone anywhere, that he has just crushed a home run to the upper deck.? That?s how VW?s ad agency must have felt when they finished ?The Force.? ?The Super Bowl commercial for the Passat family sedan features a deluded kid in a Darth Vader costume who is desperate to bend objects in his world to his significant will.? After an unsuccessful day, the kid is dumbstruck by his abrupt success bewitching his dad?s car, courtesy of the remote start function on the car?s key fob.? John Williams? ?Imperial March? score has never been more powerful.?? It has more than 46 million viewings on YouTube, and a ?making of? video with outtakes has another four million.? Plus that whole Super Bowl thing.? AdWeek named this their top commercial of the year, saying ?Few ads in history have been as charming, as clever, as perfectly paced or as well loved as this.?

Can foreign tourists help US economy?

Agustina Ocampo is the kind of foreign traveler businesses salivate over.

The 22-year-old Argentine recently dropped more than $5,000 on food, hotels and clothes in Las Vegas during a trip that also took her to Seattle's Space Needle, Disneyland and the San Diego Zoo. But she doubts she will return soon.

"It is a little bit of a headache," said Ocampo, a student who waited months to find out whether her tourist visa application would be approved.

More than a decade after the federal government strengthened travel requirements after the Sept. 11, 2001, terrorist attacks, foreign visitors say getting a temporary visa remains a daunting and sometimes insurmountable hurdle.

The tourism industry hopes to change that with a campaign to persuade Congress to overhaul the State Department's tourist visa application process.

"After 9/11, we were all shaken and there was a real concern for security, and I still think that concern exists," said Jim Evans, a former hotel chain CEO heading a national effort to promote foreign travel to the U.S.

At the same time, he said, the U.S. needs "to be more cognizant of the importance of every single traveler."

Tourism leaders said the decline in foreign visitors over the past decade is costing American businesses and workers $859 billion in untapped revenue and at least half a million potential jobs at a time when the slowly recovering economy needs both.

While the State Department has beefed up tourist services in recent years, reducing wait times significantly for would-be visitors will likely be a challenge as officials try to balance terrorist threats and illegal immigration with tight budgets that limit hiring.

"Security is job one for us," said Edward Ramotowski, managing director of the department's visa services. "The reason we have a visa system is to enforce the immigration laws of the United States."

Anti-immigration proponents argue travel to the U.S. is already too accessible and that allowing more visitors would put the nation at greater risk.

"Everybody would like to find a way to admit as many people as possible to visit here providing that they visit and then go home," said Jessica Vaughan, director of policy studies at the Center for Immigration Studies, an anti-immigration group based in Washington, D.C.

"A lot of consular officers underestimate how much people want to come and live here," she said.

Nearly 7.6 million nonimmigrant visas were issued in 2001, compared with fewer than 6.5 million in 2010. The number of visa applicants also dropped sharply after 2001. Those combined forces pushed the U.S. share of global travelers down to 12 percent last year, from 17 percent before 2001.

The proposed immigration overhaul has largely been driven by the U.S. Travel Association, the tourism industry's lobbying giant, and has been endorsed by business titans such as the National Retail Federation, Four Seasons Hotels and Resorts, and Walt Disney Parks and Resorts. Republicans and Democrats in Congress are backing the proposed changes through six bills in the House and Senate.

Geoff Freeman, the travel association's chief operating officer, said the State Department should be required to keep visa interview wait times at a maximum of 10 days.

"Every day a person is waiting for that interview is a day a person cannot be here supporting the American economy," he said.

For most foreigners, taking a last-minute business or leisure trip to New York, Los Angeles, Miami or other U.S. travel hubs would be nearly impossible. The average wait time for a visa interview in Rio de Janeiro, for example, was 87 days, according to the State Department.

The Government Accountability Office, a nonpartisan agency that audits federal programs, concluded that wait times are likely much longer than reported because some department employees artificially reduce the wait times by not scheduling interviews during high-demand periods.

The vast majority of visitors enter through the country's visa waiver program, which allows travelers from 36 nations with good relationships with the U.S. to temporarily visit without a visa. Travel proponents want to add nations whose residents are unlikely to illegally move to the U.S., including Argentina, Brazil, Poland and Taiwan.

Tourists from the rest of the world, including India, China, Mexico and other nations with affluent travelers looking to use their passports, must obtain a nonimmigrant visa. The process can be expensive and time-consuming.

People living far from a visa processing center must arrange travel to the interview location, not knowing whether they will be approved. Roughly 78 percent of all tourist visas were approved so far in 2011.

Tourism proponents want the department to embrace videoconferencing as a way to interview more people quickly. The department has no plans to implement videoconferencing interviews because of safety and technological concerns, Ramotowski said.

In-person interviews weren't the norm before 9/11, when consular officials had the authority to approve travelers based on an application alone. Since then, however, screenings have become more strenuous, with fingerprint checks and facial recognition screening of photographs.

The State Department has made moves to boost its tourist services in recent years, transferring employees from underworked offices to bustling embassies and consular posts. Many visa processing centers are also operating under extended hours.

Other proposed changes include granting more multi-entry visas and charging premium fees to tourists who want a visa right away, similar to the premium passport fee charged to Americans with last-minute passport requests. The tourism industry also wants more visa processing officers and to allow travelers to submit applications in their native language.

"We can't afford to treat them in a way that gives them an impression that maybe they aren't welcome," said Rolf Lundberg, the U.S. Chamber of Commerce's top lobbyist.

To help make the U.S. appear more welcoming, Congress approved last year a $200 million annual marketing campaign.

In Las Vegas, where travelers to the Strip have traditionally kept Nevada's economy afloat, tourism and government leaders are desperate to keep businesses open and create jobs in a state with the nation's highest unemployment rate.

"The industries affected by tourism are all behind it," said Republican Rep. Joe Heck of southern Nevada, who has sponsored a bill in the House that would require shorter visa interview delays, among other measures. "We need the jobs."

Ocampo, who spent her vacation shopping at upscale boutiques and visiting family in California, said she would be more eager to come back if she knew her business was wanted.

"Everyone wants to visit the Statue of Liberty and Disneyland," she said.

Three Tennessee miners rescued after fire (Reuters)

NASHVILLE, Tenn (Reuters) ? Three miners were trapped underground by smoke for several hours on Wednesday before being brought safely to the surface at the Young zinc mine in Tennessee, authorities said.

Two other miners were taken to a local hospital suffering from minor smoke inhalation after a drill rig caught fire at the mine in New Market, Tennessee, Fire Department Captain Sammy Solomon said.

Fifty-four miners were in the zinc mine when the rig caught fire about 800 feet from the surface, and 51 of them were able to walk out of the mine, Solomon said.

"They are on the surface, they are on the ground. They are officially out," Solomon said just before 4 p.m. local time, adding that they appeared to be fine.

A team from state-run Tennessee Mine Rescue led the trapped miners safely to the surface. The miners had been talking with authorities at the surface by phone after the fire broke out. The fire call came in about 1 p.m.

Solomon, who has been a captain of the volunteer fire and rescue unit for more than 20 years, said a mine fire was almost unheard of in New Market, a town about 15 miles north of Knoxville in eastern Tennessee.

"This is the first time it's ever happened that I could ever remember," Solomon said.

Nyrstar, which owns the Jefferson County mine and has operations around the world, said in a statement that it was working with the Mine Safety and Health Administration and mine rescue teams to ensure that it was safe to resume mining.

Jefferson County is one of four counties in Tennessee with active zinc mining and milling operations that make it the nation's second-largest zinc producer, according to state data.

Two members of Congress have called for what they describe as the first-ever federal audit of Union Station's Redevelopment Corporation, the Washington Examiner reported. The moves comes as Union Station undergoes 10 months of repairs following the Aug. 23 earthquake.

District Del. Eleanor Holmes Norton and Rep. Nick Rahall, D.-W.Va., are asking the Department of Transportation's Inspector General to investigate Union Station's management and finances as the station prepares to undergo major changes in addition to repairing earthquake damage, according to the Examiner - including expanded Metrorail access and renovations in Columbus Circle.

Milk With Cancer-Causing Toxin Destroyed

BEIJING -- China's biggest milk producer destroyed a batch found to have excessive levels of a cancer-causing toxin, in another safety scare for the country's dairy industry.

Mengniu Dairy Group said in a statement seen on its website Monday that the problem was discovered before the milk containing high levels of aflatoxin was sold to the public.

"Mengniu would like to express our sincere apologies to consumers," the company said, adding none of the tainted products had made their way into the market.

"We will draw a big lesson from this incident and will work harder to meet all national and corporate standards on quality in the future," it said.

Aflatoxin is produced by a fungus that commonly grows in grain and legume crops such as peanuts, soybeans, corn and wheat. It can be found in the milk of animals that eat tainted crops.

High levels are toxic and carcinogenic, but aflatoxin is not considered harmful at low levels.

Mengniu's statement said the tainted milk was from one of its plants in Sichuan province in southwestern China. It did not say how much milk was destroyed or how high the aflatoxin levels were.

China's food chain, and especially the diary industry, has come under increased scrutiny in recent years because of a series of safety problems.

In 2008, at least six babies died and 300,000 became sick after being feed milk powder tainted with melamine. The industrial chemical is illegally added to dairy products to make them appear higher in protein.

A dairy farmer and a milk salesman were executed and 19 other people were jailed for their role in selling the tainted milk products.

Judge weighs Fox Sports request to halt Dodgers media rights sale process pending appeal

Stark is set to hear arguments on the merits of Fox?s appeal at a Jan. 12 hearing.

Fox attorney Catherine Steege argued that the proposed media rights sale process violates Fox?s exclusive rights under an existing contract with the Dodgers, and that Fox will suffer irreparable harm if the sales process is allowed to proceed while the appeal is argued.

But Dodgers attorney James Johnston argued that Fox?s appeal was not properly before Stark because the bankruptcy court order approving the sale process was not a final order. Even if the appeal is properly before the district court, Fox has not met the criteria for an emergency stay pending resolution of the appeal, Johnston added.

But Stark wondered whether the determination by U.S. Bankruptcy Judge Kevin Gross that certain provisions of Fox?s existing contract with the Dodgers were unenforceable in bankruptcy raised a purely legal question justifying an interlocutory appeal to the district court, even if the bankruptcy court?s order is not considered final.

Stark gave no indication on when he would rule on Fox?s request for the emergency stay.

But attorneys for the Dodgers and the team?s creditors committee warned Stark that if he granted the stay, it could torpedo plans to sell both the team and the media rights by the April 30 deadline included in a settlement between the Dodgers and Major League Baseball.

?The timetable is just too tight,? Johnston said.

Johnston also argued that Fox will not be harmed if the stay is denied because the only thing that will happen between now and the Jan. 12 hearing is that Fox and the Dodgers will be trying to negotiate a new television rights deal for games starting in 2014.

The existing contract gives Fox an exclusive 45-day period starting in October 2012 to try to negotiate a contract extension with the Dodgers. During that time, the Dodgers are prohibited from talking to other parties before Nov. 30 of next year.

The sales process approved by Gross moves up the exclusive negotiating period by about 10 months, giving Fox until Jan. 19 to strike a new deal with the Dodgers. Even if current Dodgers management reaches a new telecast rights agreement with Fox, that agreement still would be subject to approval by the successful bidder for the team, a condition Fox says decreases its leverage in negotiations.

?They?re going to take whatever is negotiated and shop it around,? Steege said.

In his order, Gross also said ?no-shop? provisions in the existing contract were unenforceable in bankruptcy. The provisions prevent the Dodgers from talking to third parties before Nov. 30, 2012, and give Fox a limited right of first refusal on competing offers received after that date.

Steege told Stark that Gross exceeded his authority, arguing that the bankruptcy judge effectively rewrote the contract between Fox and the Dodgers.

?The bankruptcy court substituted new contractual terms unilaterally proposed by the Dodgers without the consent of Fox Sports,? she said. ?... Courts cannot rewrite contracts for the parties.?

The Dodgers sought bankruptcy protection in June after baseball Commissioner Bud Selig rejected a new TV deal with Fox that Dodgers owner Frank McCourt was counting on to keep the franchise solvent. After the bankruptcy filing, attorneys for Selig successfully fought to force the Dodgers to accept bankruptcy financing from Major League Baseball, arguing at the same time that McCourt should be forced to sell the team.

After threatening to seek bankruptcy court permission to sell the media rights without the approval of MLB, the Dodgers reached an agreement with the league that calls for a sale of both the team and the media rights.

The April 30 sale deadline in the settlement between the Dodgers and MLB coincides with the deadline for McCourt to pay $131 million to his ex-wife, Jamie, as part of their divorce settlement.

A group of researchers at IMEC believes that holographic video might be the best way around this problem and has been working on a means of constructing holographic displays by shining lasers on microelectromechanical systems (MEMS) platforms capable of moving up and down like small, reflective pistons. Here's the cool part: each pixel would have a spring-like mechanism attached to it that could be moved by applying voltage to it. In the first stage of the technology, a laser is bounced off a MEMS-less chip containing an image, the diffracted light interfering to create a 3D picture. From here, the team can adjust the image by replacing pixels with small, mirrored platforms that can alternate their direction to create a moving projection. It gets technical after this, but you can take a gander at the video after the break for a full demo and explanation.

Most commercial properties of less than $ 5,000,000 are generally too large for most residential investors, too small for most institutional investors.

3). Commercial Real Estate allows a ?forced? Appreciation

Residential properties are generally based on comparable properties that were sold in the region and are rated similar in functionality. Queen Elizabeth visits husband in hospital (AP)

LONDON ? Queen Elizabeth II's husband is expected to spend a second night in a hospital where he is recovering from a heart procedure, palace officials said Saturday.

Prince Philip, 90, had a coronary stent put in late Friday to fix a blocked artery, though the palace has refused to say if he had a heart attack.

On Saturday, Philip ? also known as the Duke of Edinburgh ? received visits from the queen and his four children at Papworth Hospital, where he was admitted after experiencing chest pains at the queen's Sandringham estate in Norfolk.

The illness has cast a shadow over the royal family's traditional Christmas gathering at Sandringham ? the first to include Prince William's new wife, Catherine. Buckingham Palace said Philip is not expected to attend church Sunday with his family, but that the service will go on as planned.

A helicopter brought Elizabeth to her husband's side at Papworth Hospital, about 70 miles (115 kilometers) from London, shortly after 11 a.m. (1100 GMT, 6 a.m. EST) on Saturday. She was accompanied by three of her children ? Princess Anne, Prince Edward and Prince Andrew.

Philip is "in good spirits, but he is eager to leave," Buckingham Palace said. After spending 45 minutes with Philip, the royals traveled back to Sandringham by helicopter, it added.

The palace said Prince Charles and his wife, Camilla, arrived by car at the hospital 45 minutes after the queen for a separate visit and that no other family members were expected to visit on Saturday.

Doctors said Philip could have had a heart attack, but without more information it was impossible to know for sure.

Coronary stenting is standard procedure both to fend off a heart attack or save a patient already in the midst of one, said Dr. Allan Schwartz, chief of cardiology at New York-Presbyterian, Columbia University Medical Center.

Philip, who in November marked 64 years of marriage to the queen, has been known to enjoy good health throughout his life and rarely misses royal engagements. Upon his 90th birthday in June, he announced plans to cut back his official duties.

In addition to well-wishers gathered outside Papworth Hospital, Prime Minister David Cameron also offered his support to Philip.

"The prime minister has been kept informed of the situation and wishes the Duke of Edinburgh a very speedy recovery," Cameron's office said.

Doctors say that some patients can leave the hospital a day after a similar medical procedure, but the palace said it does not know when Philip will be discharged. It said the prince remains "under observation" and that he is having a "short stay" in the hospital.

Members of the royal family were due to start arriving at Sandringham, where Philip had been since Monday, throughout the day Saturday.

While members of the public who gather each year to catch a glimpse of the royals walking to Sunday's traditional church services will most likely not see Philip, Buckingham Palace said it does not expect changes to the rest of the royal family's Christmas agenda.

Another key part of the royal family's Christmas celebrations is the queen's annual message to the nation, which this year will focus on family and community.

The queen has made a prerecorded Christmas broadcast on radio since 1952 and on television since 1957. She writes the speeches herself, and the broadcasts mark the rare occasion on which the queen voices her own opinion without government consultation.
