Camilla Williams, black opera pioneer, dies at 92 (AP)

INDIANAPOLIS ? African-American opera pioneer Camilla Williams has died in Bloomington. She was 92.

Williams' attorney, Eric Slotegraaf, said in a statement that the soprano died Sunday.

Indiana University Jacobs School of Music spokesman Alain Barker said Williams died of complications from cancer.

The school says Williams became the first African-American female to appear with a major U.S. opera company when she debuted on May 15, 1946, with New York City Opera in the title role of Puccini's "Madama Butterfly."

She became the first African-American professor of voice at IU in 1977 and retired in 1997.

Williams was born in Danville, Va., on Oct. 18, 1919, the daughter of a chauffeur. Her grandfather was a singer and choir leader, and by age 8 she was singing in Danville's Calvary Baptist Church.

Researchers find cancer in ancient Egyptian mummy - Home ...

CAIRO (AP) ? A professor from American University in Cairo says discovery of prostate cancer in a 2,200-year-old mummy indicates the disease was caused by genetics, not environment.

The genetics-environment question is key to understanding cancer.

AUC professor Salima Ikram, a member of the team that studied the mummy in Portugal for two years, said yesterday the mummy was of a man who died in his forties.

She said this was the second oldest known case of prostate cancer.

"Living conditions in ancient times were very different; there were no pollutants or modified foods, which leads us to believe that the disease is not necessarily only linked to industrial factors," she said.

A statement from AUC says the oldest known case came from a 2,700 year-old skeleton of a king in Russia.

Pesticide may worsen honeybee virus

A common pesticide used by beekeepers to kill honeybee-infecting mites temporarily leaves the bees more susceptible to a debilitating virus, new research suggests.

From parasitic flies to numerous viruses, honeybee colonies across the globe have a lot of things threatening their survival, but perhaps no stressor is as disastrous as varroa destructor mites. The tiny vampiric arachnids latch onto bees of all stages of life and suck their "blood." Often in the process, the mites deliver to the bees deformed wing virus ? which causes wing disfigurements in developing pupae, resulting in flightless bees that die shortly after their emergence. Both these mites and the deformed wing virus have been implicated in colony collapse disorder, and together they can wipe out an entire honeybee colony within a few years if left untreated, scientists have found.

The most successful weapon against these mites (at least those that haven't developed a resistance) has been pesticides called acaricides. However, scientists know little about the chemicals' effects on honeybee viruses. To find out, Joachim de Miranda, a bee ecologist at the Swedish University of Agriculture Sciences in Uppsala, Sweden, and his colleagues studied the effects of the common acaricide Apistanon levels of several viruses in honeybees.

To their surprise, they found that concentrations of deformed wing virus in treated bee colonies initially increased for a period, before ultimately dropping when more mites died (though the virus levels didn't fall below those seen in untreated colonies until the last week of the six-week treatment used in the study).

If future studies conclusively show that Apistan causes a spike in the virulence of deformed wing virus, the findings could have implications for beekeepers, the researchers say.

"Make sure that you know that you absolutely have to treat before treating with acaricides," de Miranda told LiveScience. "If you don't have a lot of mites, then this treatment will only cause you more damage."

Of mites and viruses
During the winter, honeybees do not hibernate, but instead cling tightly together on the combs in the hive to form insulating "clusters." While in the cluster, the bees still rear young and consume food, but all reproduction is stopped. Because the bees need a critical number of members to effectively block out the cold, the colony must be healthy before and during the chilly season.

"They have to be as healthy as possible going into the winter to survive and produce the next generation during the spring before dying off," de Miranda explained.

Previous studies showed that colonies that were effectively mite-free were still dying over winter, and bees that died had elevated levels of deformed wing virus, said Stephen Martin, a varroa mite expert at the University of Sheffield in the United Kingdom, who was not involved in the current research. "What we suspect is that the virus has now changed ? it was initially reliant on varroa, but now virulent forms don't rely on that kind of transmission," Martin said, referring to the fact that over the winters, when the mites are dead, the virus can still be transmitted to other bees through their regurgitated food.

In light of this fact, beekeepers need to know how soon before winter they need to start treating their colonies for varroa mites, to ensure that the bees make it to spring.

A balance of evils
The researchers don't yet know what could have caused the initial spike they saw in deformed wing virus in the pesticide-treated bees, but suspect that Apistan could be working synergistically with the virus against the bees; alternatively, the chemical may be negatively affecting bee immunity, leaving them more vulnerable to the deformed wing virus.

Whatever the case, the study doesn't conclusively show that Apistan had an effect on virus levels, and the results could just be a statistical anomaly, Martin told LiveScience. The researchers are now looking to test how Apistan affects virus levels in the absence of varroa mites.

De Miranda doesn't think beekeepers should be alarmed, because the virus spike wasn't significant enough to cause major damage, though using pesticide to treat bees with just low levels of the mites may not be the best idea. Colonies highly infested with mites need to be treated, he said, adding that "you have to see it as sort of a balance of different evils."

At the very least, the study shows that beekeepers should probably treat their colonies for more than six weeks ahead of chilly weather, because there were still substantial levels of deformed wing virus at the end of the study treatment.

"Beekeepers need to be aware that viruses don?t sit still and things are continually changing," Martin said. Fifteen years ago acaricides that killed mites also reduced virus levels, but this is clearly not happening anymore, he said. "Things are not as straightforward as we once believed."

The study was published in the January issue of the journal Applied and Environmental Microbiology.

Report: Facebook IPO filing could come next week

(AP) ? Facebook could file regulatory papers as early as Wednesday for its highly anticipated initial public offering of stock, according to a newspaper report.

Facebook's expected launch as a publicly traded company is the most hotly anticipated tech IPO in more than a decade. It would vault it into the top ranks of the largest public companies in the world, on par with the likes of McDonald's Corp., Amazon.com Inc., Visa Inc. and Bank of America Corp.

The Wall Street Journal, citing unnamed people familiar with the matter, said Friday that the social-networking company could raise as much as $10 billion in an offering that would value the company at $75 billion to $100 billion.

Either measure would dwarf the $1.67 billion raised in Google's 2004 IPO. That offering gave Google a market value of $23 billion. Google is now worth $184 billion.

CEO and founder Mark Zuckerberg, 27, is already considered a billionaire because of shares traded on a closed market.

Facebook spokesman Larry Wu said the company will not comment on IPO-related speculation.

After filing its initial paperwork, a public offering usually takes three to four months.

The Real Housewives of Orange County Season 7 Preview: Double D-licious!

We're less than two weeks away from the return of Bravo's longest-running franchise, The Real Housewives of Orange County.

What scripted drama have writers come up with for cast members Tamra Barney, Gretchen Rossi, Alexis Bellino, Vicki Gunvalson and Heather Dubrow? E! News has spoken to a number of them and provided the following preview:

The Real Housewives of Orange County Season Seven Cast

Barney has downgraded in the chest department, reducing the size of her 34 Double Ds - and she couldn't be happier about it.

"It's been one of the best things I have ever done in my life," she says. "I feel a lot more confident without my implants."

Rossi, meanwhile, worried that newbie Dubrow might "have a stick up her ass," but Heather says she was "pleasantly surprised [by] how well we all got along" on the show. Boring!

Gretchen and Vicki will have it out over Slade Smiley, the former's shady boyfriend. Won't Tamra also have a lot to say about him, too, considering past comments? No, actually:

"I knew that the only way to move forward was just to forgive and ask for forgiveness," Rossi says of her and Tamra's relationship. "It has become a very true and authentic friendship."

Vicki's divorce from Don will also take center stage. And, of course, THG will be there every step of the way with weekly reviews and commentary!

Samsung cracks open Galaxy Note, reveals tabletphone components within

    Galaxy Note teardown

Usually we have to wait for some brave individual to take screwdrivers, spudgers and the like to a device before we get to see what's lurking inside. This time, however, Samsung's saved you the trouble of voiding your warranty and being left with a heap of broken circuitry, with an official teardown of the Galaxy Note, its unique phone/tablet hybrid.

If you've never looked inside one of these things before, it's always amazing how so much "stuff" is packed within a (relatively) small device. In the case of the Galaxy Note, the S-Pen stylus integration requires a special digitizer to detect the pen's presence and the amount of pressure, as well as a WACOM chip to process pen input.

Hit the source link for a more detailed breakdown of what's inside the Galaxy Note, or check out our full review for more on the device itself.

Timberwolves, Love reach 4-year extension (AP)

MINNEAPOLIS ? Kevin Love is staying with the Minnesota Timberwolves.

Love and the team agreed to a four-year contract extension worth between $60 million and $62 million, a deal that includes an early termination option for Love in the final year.

The All-Star power forward and the team faced an 11 p.m. Wednesday deadline to sign an extension. If not, Love would have become a restricted free agent this summer.

Love will make the maximum amount of salary for the four years, but he did not get the five-year deal for which he was hoping. The new collective bargaining agreement allows for franchises to give one player on the roster a five-year deal that would have been worth roughly $80 million for Love this time around.

Love said Timberwolves owner Glen Taylor and president of basketball operations David Kahn did not want to offer the five-year deal to the All-Star power forward.

"Did I want the five years? Of course," Love said on a conference call from Dallas, where the Timberwolves were scheduled to play the Mavericks on Wednesday night. "It was something I felt strongly about, but at the end of the day, a four-year deal is still great."

Oklahoma City gave Russell Westbrook a five-year deal and Chicago signed MVP Derrick Rose to a five-year deal as well.

"They're in totally different positions," Love said, pointing out that the Thunder and Bulls are both considered championship contenders while the Wolves haven't been to the playoffs since 2004.

As the clock ticked down, Love said the situation was weighing on him and he wondered if the deal would get done.

"I was willing to make a commitment for five years. They thought otherwise," he said. "I'm glad this is out of the way. It was drawn out until 8 a.m., 9 a.m. this morning."

Love ranks fifth in the league with 24.9 points per game, second with 13.9 rebounds and first with 39.4 minutes played. He has emerged as the face of the franchise and is a key building block for the team and new coach Rick Adelman.

The new collective bargaining agreement allows the Timberwolves to offer Love more money than any other team.

Love is in his fourth season in the NBA. The son of a former NBA player and nephew of a Beach Boys icon, Love was a high school star in Oregon, an All-American in his only season at UCLA and last year led the NBA in rebounding. He became the first player in more than two decades to have 30 rebounds and 30 points in the same game and became an All-Star in just his third season as a pro.

The four-year deal gives the Timberwolves some flexibility going forward and keeps that maximum offer available for point guard Ricky Rubio, No. 2 overall pick Derrick Williams or another player down the road.

"It's good to have our centerpiece," Williams said. "We need a guy like him to put up 25 and 10 every night. ... I had a feeling he would stay with the fan base he's built."

Obama to 'hang out' in live video chat room

(AP) ? President Barack Obama plans to "hang out" in a video chat room to answer questions about his State of the Union address, part of a White House effort to test new social networking tools and the latest evidence of the growing intersection of social media and politics.

Google announced Monday that Obama will participate in a 45-minute live video chat room known as a "Hangout," part of the online search giant's social networking site Google Plus. The chat will take place Monday afternoon, Jan. 30, capping a week of social media engagement the White House is planning around the State of the Union speech.

Obama speaks to Congress and the nation on Tuesday.

Google Plus will solicit questions over the video sharing site YouTube, and users will then vote on their favorites. The president will answer some video questions, and will also chat directly with a group of the questioners.

The exchange will appear on the White House Google Plus page, and will be live streamed on the whitehouse.gov website.

Obama participated in YouTube town halls after his last two State of The Union speeches, taking questions submitted to the video sharing site. The planned Hangout goes a step further, offering some of those questioners a chance to interact directly with the president.

Macon Phillips, White House director of digital strategy, said the White House would have no role in choosing the questions or participants in the Hangout.

"For online engagement to be interesting, it has to be honest," Phillips said. "We want to give Americans more control over this conversation and the chance to ask questions they care about."

Google has hosted Hangouts with other political figures, including Republican presidential candidates Mitt Romney and Newt Gingrich. But Obama's planned Hangout will be a presidential first and is certain to draw more attention to Google Plus, which has battled to catch up with social networking giant Facebook in membership and influence.

The Hangout element "will make for really personal conversation with the president that's never really happened before," said Steve Grove, head of community partnerships for Google Plus. "Whether it's good for Google Plus or not, I guess viewers will decide by how well we pull it off."

Google, Facebook and other social media sites have been steadily boosting their presence in electoral politics.

Facebook cosponsored a Republican primary debate with NBC News earlier this month, and last year Obama visited Facebook's headquarters in California, where he took questions submitted to the site.

Google sponsored a Republican debate with Fox News in September and has been a go-to hub for online political advertising.

Quality of life for younger breast cancer patients more adversely affected than older women

Quality of life for younger breast cancer patients more adversely affected than older women

    Monday, January 23, 2012

Quality of life in younger patients treated for breast cancer is seriously compromised and these women suffer from severe psychological distress, infertility, premature menopause, a decrease in physical activity and weight gain, according to a study by researchers at UCLA's Jonsson Comprehensive Cancer Center.

The study, published in the peer-reviewed Journal of the National Cancer Institute, found that the mental issues faced by younger breast cancer survivors were more serious than the physical impacts compared to a general age-matched population of women who didn't have cancer and those more than 50 years old who did.

The study points to the need for oncologists to let these younger patients know from the beginning of their therapy what may happen to them after it's finished, said study lead author Dr. Patricia Ganz, director of cancer prevention and control research at UCLA's Jonsson Comprehensive Cancer Center.

"We know that educating and providing younger breast cancer patients with information about what they might experience once their treatment ends is very helpful," said Ganz, who has been conducting research on quality of life after cancer treatment for 25 years. "If they know what to expect, their anxiety level will be greatly reduced. Up to now, oncologists have not done a good job of preparing these women for what will come."

Reducing anxiety is crucial, Ganz said, as pre-clinical studies have shown that stress can promote cancer growth and spread in animal models. A study by Jonsson Cancer Center researchers published in 2010 in Cancer Research showed that chronic stress acted as a sort of fertilizer that fed breast cancer progression, significantly accelerating the spread of disease.

The need to prepare younger breast cancer survivors for any adverse effects they may experience and seek ways to address those problems is vital as more and more younger women are surviving their cancer diagnosis due to improvements in early detection and treatment, Ganz said.

"A cancer diagnosis can challenge younger women with issues that don't impact older patients," she said. "A younger breast cancer patient may have young children and may be worried about living to raise them to adulthood. A younger breast cancer patient may not have had children yet and may be faced with infertility following her treatment or may return to the dating scene following treatment. We need to find ways to reduce the stress and anxiety that dealing with these issues may create."

Ganz recently received a grant from the Centers for Disease Control and Prevention that will fund a leading-edge program that seeks to enhance outcomes for young breast cancer survivors in the Los Angeles region. The program is being done in collaboration with the Jonsson Cancer Center, the UCLA-LIVESTRONG Survivorship Center of Excellence and the Simms/Mann ? UCLA Center for Integrative Oncology.

The three-year, $700,00 grant will focus on making life after breast cancer better for women aged 21 to 45 in Los Angeles County by funding a program designed to meet their unique needs, Ganz said. UCLA is one of seven organizations nationwide to receive funding for this focus on young breast cancer survivors. The resources and strategies developed in this diverse and populous region will serve as a model for other organizations across the country.

Services will be offered to these women through the UCLA Health System and with collaborators at Torrance Memorial Medical Center and the South Bay Cancer Survivorship Consortium, as well as the Olive View-UCLA Medical Center, a public hospital in northern Los Angeles County which treats mostly minority women who are underinsured or who have no insurance.

"These three health systems provide breast cancer services for a substantial number of ethnically diverse, newly-diagnosed women with breast cancer under 45 years old. They see about 225 new cases annually," Ganz said Ganz. "We estimate that there are hundreds of young breast cancer survivors who are being followed in these institutions, who will directly benefit from the programs that we will develop."

Ganz anticipates such services might include a regional resource with information and assistance in obtaining fertility preservation services, a website that hosts specialized information about community and hospital resources for younger women with breast cancer, as well as specialized programs to meet the unique psychosocial needs and concerns of this population.

Ganz also has received a grant from the Susan G. Komen foundation that is testing the practice of mindful awareness, a form of meditation, as a way to combat stress and anxiety in younger breast cancer patients.

For the Journal of the National Cancer Institute study, Ganz and her team did a review of studies that focused on overall quality of life, psychosocial effects, menopause and fertility-related concerns and behavioral outcomes related to weight gain and physical activity. The 28 studies reviewed were published between January 1990 and July 2010.

Ganz said that weighing therapies with the thought of quality of life after treatment in mind may help reduce some of the issues these younger women face.

"By tailoring adjuvant therapy regimens and giving cytotoxic therapy only to those who may benefit, we can mitigate some of these side effects, but the long life expectancy for these young women also provides a window of opportunity for cancer prevention and health promotion activities," the study states.

6 considerations before starting a business - Holy Kaw!

If becoming your own boss is high on the to-do list for 2012, your best bet is to listen to the advice of those who have blazed the path of starting a business before you, so 2013, 2014 and beyond may still find you in the driver?s seat.

Nellie Akalp has been there on a number of occasions and wants to pass on the things she wished she knew when starting her first ? and even second ? business.

    1. Don?t underestimate a business plan.

If you?re not seeking outside funding at the start, it?s tempting to forgo writing out a formal business plan. However, taking the time to write out your business plan, forecasts and marketing strategy is a particularly effective way to hone your vision. All planning should center around two essential questions: How is my business serving a particular need or pain point, and does this represent a major market opportunity?

In addition, don?t overlook the exit strategy at the beginning. Do you want your children to take over the company? Do you want to sell it? It?s critical to think about these questions from the start, as the building blocks of your company (such as legal structure) should vary depending on your preferred final outcome.

    2. Don?t get stuck in the past.

My husband and I launched our first online legal document filing service in 1997, and then re-entered the market with our second company in 2009. While our previous experience certainly gave us a leg up the second time around, we soon realized the market landscape had changed dramatically since our first company. We had to stop dwelling on previous competitors, customer needs and service expectations and write a brand new playbook.

The marketplace and your business plan are living entities; they?re continually in flux. Whether it?s your first company or fifth in a given market, you?ve got to keep asking: What do we need to do today?

South Carolina Primary Goes To Newt Gingrich

Mitt Romney had a sizable lead going into the week only to fall short to the onetime House speaker.
    By Gil Kaufman

If it weren't clear before, the results of the South Carolina primary Saturday night (January 21) made it crystal that former Massachusetts Governor Mitt Romney is in for the fight of his political life in his quest to nab the Republican presidential nomination. After holding on to a double-digit lead as recently as Tuesday, Romney came up short in South Carolina, defeated by a surging Newt Gingrich.

Buoyed by two solid debate appearances this week, former House Speaker Gingrich managed to turn the tide in the first contest in the South, proving once again that the party faithful are not yet willing to fall into lockstep and give Romney a smooth ride to the nomination. Gingrich pulled off the upset victory despite a potentially crushing distraction Thursday in the form of an ABC News interview with his second ex-wife. In it, Marianne Gingrich claimed the ex-congressman had asked her to agree to an open marriage so he could carry on an affair with his now-third wife.

Romney started the week with a solid lead, but the distance between him and Gingrich shrunk in the days before the primary. In addition, on Thursday, the race was scrambled thanks to a trio of unforeseen events that further muddied the waters.

First, Republican leaders in Iowa announced that the final count in that state's caucus revealed that Romney's eight-point win over Rick Santorum was actually a 34-point loss, which handed the former Pennsylvania senator a pyrrhic victory in that first-in-the-nation contest. A short time later, Texas Governor Rick Perry announced he was suspending his campaign and would be throwing his support behind Gingrich, which could solidify the former House leader's draw to the all-important bloc of Evangelical Christian voters. The third shoe to drop was the ABC interview.

By Friday night, a Romney adviser told CNN the race was "real tight," even as a Gingrich staffer predicted a victory after the candidate came in fourth place in the two previous primaries. Santorum and Libertarian candidate Congressman Ron Paul were in a fight for third place at press time. Before results were announced, CNN reported that exit polls show the most important quality for Republican voters is that a candidate can beat President Obama.

Experts told MTV News that if Romney landed his second win in a row, he might take the wind out of Gingrich's sails and get one step closer to a virtual lock on the nomination should he win the next test, the January 31 primary in Florida. A further black cloud over the Gingrich win for Romney: The winner of the S.C. primary has gone on to secure the Republican nomination in every election since 1980.

Long considered the front-runner and likely nominee, Romney has gone from looking like he would win an unprecedented three primaries in a row to start the season to just one victory and continuing questions about his appeal to the party's conservative base. Though his campaign continues to be far ahead of the rest of the field in fundraising, even if Romney can pull it out, the constant battering of his image and résumé by his rivals for the nomination could leave him deeply scarred by the time the general election rolls around.

According to Fox News, the bigger problems for Romney, though, based on some early exit polls from South Carolina, are that voters are concerned about his moderate stance on some issues and his Mormon faith. Romney is vying to be the first Mormon Republican presidential candidate.

With another close loss behind him, Romney turns his attention to Florida, a state that has proved pivotal in the last three elections and one that is now a virtual must-win in order to keep his campaign steaming forward.

For the second time in this election, Gingrich has stampeded back into the game and political experts said that his effort is, even if it goes no further, is one of the finest examples of political savvy in memory.

Check back for up-to-the-minute coverage on the primary races and stick with PowerOf12.org throughout the 2012 presidential election season.

Emma Roberts Channels Ke$ha In 'Celeste And Jesse'

'I got to bring together every pop star and mold it into one person,' actress tells MTV News.

PARK CITY, UtahEmma Roberts has always been a friend to MTV News, particularly at the Sundance Film Festival. Last year in Park City, we were fairly sure that we got Emma to drop a massive "Scream 4" spoiler — namely that she wasn't going to survive her encounter with Ghost Face — and we were right ... partially.

At this year's Sundance, our conversation with Emma was not so grim. The up-and-coming actress has a starring role in "Celeste and Jesse Forever," a comedy about a divorcing couple struggling to maintain their friendship during an intense period of transition. In the film, which also stars co-writer Rashida Jones, Roberts goes against type as a pop star named Riley, who is an amalgamation of various musical icons. But according to the actress, there's one particular singer she took her cues from.

"I got to bring together every pop star and fold it into one person," she told MTV News about her role in the film. "[But] my hair is definitely Ke$ha. I have these fabulous long, blond, slightly ratty extensions. I miss those dearly."

Of course, hair alone does not make a pop star. Roberts had to sing and dance to get into the role, rocking out with a dance anthem that was co-written by Jones herself.

"We recorded a song that Rashida co-wrote with a bunch of people, and it's just wildly entertaining and inappropriate and it's kind of a dance anthem. It was fun," she said. "You know when you listen to songs and they yell at you to have fun? That's kind of what we decided to do, because I love being yelled at to have fun and dance!" Who doesn't?

The 2012 Sundance Film Festival is officially under way, and the MTV Movies team is on the ground reporting on the hottest stars and the movies everyone will be talking about in the year to come. Keep it locked with MTV Movies for everything there is to know about Sundance.

Madrid's Pepe apologizes for Messi foot stomp

    Lionel Messi

    updated 4:23 p.m. ET Jan. 19, 2012

MADRID - Real Madrid's Pepe has apologized to Lionel Messi for stepping on the Barcelona forward's hand during this week's Copa del Rey quarterfinal, saying that it wasn't intentional.

Pepe told Real Madrid's website Thursday that "as far as the play with Leo Messi, I want to say that it was an involuntary act."

The Portuguese defender added that "even so, if Messi is offended I ask his forgiveness because I want to defend my team and club. ... It never passed through my head to cause harm to a fellow professional."

Pepe received a yellow card in the 17th minute of Madrid's 2-1 loss during Wednesday's first leg when he barged into Sergio Busquets, but referee Muniz Fernandez did not penalize him for stomping on Messi's hand when the forward was on the ground in the 68th minute.

Pepe also fell to the field in the 65th minute clutching his face after coming into contact with Cesc Fabregas, but replays showed the Barcelona midfielder made contact with his arm and chest.

Pepe's actions, as well as Madrid's defensive tactics, have been widely criticized in the Spanish media, including the Madrid-friendly sports dailies.

Madrid coach Jose Mourinho said in the post-match news conference that he hadn't seen the incident, but that it would be "punishable" if it was done on purpose.

The 28-year-old center back has collected eight yellow cards in 11 "clasico" matches and a red card in last season's Champions League semifinal with Barcelona. Pepe was suspended for 10 games in April 2009 after lashing out at two Getafe players in a skirmish that included him stamping on the back of Javier Casquero after pushing the player to the ground, unprovoked.

The second leg of the total-goals quarterfinal will be played at Barcelona's Camp Nou stadium next week.

Barcelona has beaten Madrid 10 times in their last 13 meetings. This was its sixth win against Madrid since Mourinho arrived in 2010.

Mandy Walker: No Cooling Off For Divorcing Couples In Colorado

This past week marked the opening of Colorado's current legislative session and Sen. Kevin Lundberg, R-Berthoud, announced that he has decided not to introduce a bill that would have required parents considering divorce with minor children to attend mandatory training on the impacts of divorce on children. The bill would also have introduced a waiting period before filing for divorce.

I applaud Lundberg's decision; legislation of this nature is problematic on many levels.

At the highest level is the clear implication that children are always better raised within a marriage than by divorced parents -- a presumption that is not surprising given that Lundberg says he got the idea for the bill from a presentation by a member of the Coalition for Divorce Reform at a legislative conference for socially conservative lawmakers. But it's not a notion I support. Marriages, just as divorces are not all equal.

I do believe that generally children do best when their parents are actively involved, but marriage is not predictor of the level of involvement and I've seen many examples of where the level of engagement has actually increased following divorce.

While Lundberg's proposed legislation would have granted exceptions for physical abuse, drug and alcohol addictions, and long term incarceration of a spouse, there are many other situations which are just as qualified: a gay spouse, multiple infidelities, pornography or gambling addictions, sexual problems for which the spouse refuses to seek treatment, financial abuse, and even several rounds of couples counseling. The list goes on.

To cover all the possibilities would be virtually impossible. The alternative then is to make provision for applying for an exemption, except that this creates the undesirable situation of someone in authority making a subjective decision.

I realize that legislation like this is intended to create a speed bump in the divorce process by getting couples to give additional consideration to their decision, but by mandating this training at the attendees' expense, it will be adding a cost to a process that many couples already find prohibitive. Additionally, a spouse -- most typically the woman -- may find herself with no access to marital assets through the actions of a financially controlling spouse. Would this legislation force a woman in these circumstances back to a troubled marriage?

On a practical level, such training courses have to be created and approved. Who determines the content and who monitors the quality, objectivity and results? Surely not a state government whose funding of education is close to the lowest in the nation?

Colorado already has mandatory parenting classes for divorcing couples and that's where there's potential for a creating real and positive impact for the betterment of children, but based on my own experience, I'm skeptical. I attended that class on my own. I'm assuming my ex attended a class but I don't know since it's not something we've ever discussed. My class started with the therapist saying, "You're all here because you absolutely have to be here so I'll try to make this as short as possible," which is hardly inspiring, motivating or enlightening.

Lundberg told the Denver Post he thought it was too easy to get out of a marriage. I think it's too easy to get into a marriage but I don't want government legislating that either.

    Sony Micro Vault MACH
120 MB/s reads and 90 MB/s writes are far from the fastest in the thumbdrive game, but they're nothing to sneeze at either. While Sony's Micro Vault MACH may not lead the pack in raw speed, it holds its own and looks damnably good doing it. The USB 3.0 stick is cased in a brushed aluminum shell and sports a red indicator LED that, if it moved, might make it look like you had a Cylon attached to your PC. The drives should be available later this month in 16, 32 and 64GB varieties, though, pricing is still a mystery. Check out the gallery below and PR after the break.

(AP) ? Hosni Mubarak, on trial for his life, is ferried to court by helicopter from a presidential hospital suite. His sons and co-defendants swagger in wearing designer track suits and no handcuffs. His security chief is treated with near reverence by police in the courtroom.

For activists in Egypt, the scenes only deepen their feeling that the authoritarian system the ousted president oversaw remains largely in place, almost a year since the 18-day uprising that toppled him.

When Mubarak's trial began five months ago, many hoped it would bring not only punishment but a clear sense of victory for a movement that aimed to wipe the slate clean and start again.

Instead, it has boiled down to a bare-knuckled showdown between supporters and foes of the "revolution," reflecting the tensions that have been gripping the country.

Those divisions were clear in court Tuesday as Mubarak's defense began its arguments. His chief lawyer, Farid el-Deeb, went for maximum effect with flowery language depicting him as an unjustly maligned victim who tried to improve Egypt during 29 years in power.

"This man before you, who is 83, has been fatigued and burdened by ailments and mauled by the malice of cunning people," el-Deeb said.

"He is looking to your justice to save him from the oppression that surrounds him from every direction, after his reputation and history have been targeted by tongues and pens."

The courtroom erupted when he said that Mubarak in fact supported the revolution. El-Deeb quoted from a letter he said Mubarak wrote to his lifetime friend Ahmed Shafiq ? who was prime minister at the time of the uprising ? saying that protesters were exercising their right to stage peaceful protests but were infiltrated by criminals and Islamists who destroyed public property and challenged the regime's "legitimacy."

"Lies, lies!" and "Execution for Mubarak!" screamed the lawyers representing the families of protesters killed by police during the revolution.

They rushed at el-Deeb and nearly set upon him, but court police quickly moved to keep them back.

Mubarak, who has worn an unwaveringly grim expression ever since the trial began on Aug. 3, looked content as el-Deeb praised him. For the first time in the trial, he sat in a wheelchair in the courtroom cage where the defendants are kept, rather than lying on a hospital gurney as he has in previous sessions.

Mubarak, his former security chief Habib el-Adly and four top security officers are charged with complicity in the killing of hundreds of protesters and could face the death penalty if convicted. Mubarak's sons Alaa and Gamal, along with their father, are charged with corruption in the same trial, a crime that would carry a prison sentence.

But the near-melee over el-Deeb's speech gave a peek into the issue running under the surface of the trial: what the revolution has really meant for Egypt.

That issue has polarized Egyptian politics since Mubarak's Feb. 11 ouster and the takeover of the reins of power by army generals widely believed to be beholden to him, led by his loyal defense minister of 20 years, Field Marshal Hussein Tantawi.

Many of the activists who engineered the anti-Mubarak protests see the generals as just an extension of their former patron's regime with no interest in bringing significant change. Notably, the military only ordered the arrest of the former president and his two sons after mass protests demanding that they be brought to justice.

Activists also charge that the generals have methodically tried to divert attention away from the revolution's main goals ? freedom, democracy and social justice ? and instead decreed a cumbersome transition, allowing Islamist parties to dominate the political landscape and missing what they see as a historic chance to become a truly democratic state.

At the same time, the generals have gone to great lengths to discredit protest leaders and capitalize on Egyptians' longing for stability by demonizing the revolutionaries as foreign agents and troublemakers while projecting an image of themselves as the nation's true patriots.

Activists, lawyers for the victims and some in the public see the soft treatment for the defendants as evidence that those in power still grant Mubarak and those around him the aura of prestige.

Police assigned to courthouse security have been captured on camera offering their former boss el-Adly a salute as he arrived for one of the early hearings. Those images caused an uproar, but el-Adly, who as interior minister commanded the intensely hated police force, continues to walk from the armored police vehicle that brings him from jail to the courtroom without escort or handcuffs. Dark sunglasses, a navy blue baseball cap and a matching prison uniform have become the iconic look of a man whose name once struck fear in the hearts of the regime's foes.

Similarly, Mubarak's sons parade boldly into the courthouse, with Alaa carrying a purple chair that he sits on when inside the defendants' cage. Both Alaa and Gamal, who barely a year ago was thought to be Egypt's second most powerful man after his father, wear immaculate white track suits with matching sneakers.

Two other security commanders face dereliction of duty charges in relation to the crackdown on protesters in the trial. A friend of the Mubarak family, Hussein Salem, who has fled the country, is also a defendant in the corruption component of the trial.

Activists grumble that the treatment contrasts with the use of deadly force by troops in recent months against peaceful protesters demanding that the generals step down immediately ? as well as the use of cursory military tribunals to prosecute at least 12,000 civilians, including protesters, since the generals took over. Those rounded up over the months from Tahrir Square complained of being beaten, hit by clubs or shocked by stun guns while in police custody.

The prosecution last week gave a startlingly harsh and dramatic denunciation of Mubarak in its courtroom summations, calling him a tyrant who maneuvered to get his son Gamal to succeed him.

Tuesday's hearing was the first of five set aside by Judge Ahmed Rifaat to hear the defense argue its case. El-Deeb, who over the years built a reputation as a suave and expensive celebrity lawyer, sharply criticized the prosecution's comments, saying it used phrases that "for no reason insulted Mubarak."

"Mubarak is neither a tyrant nor a bloodthirsty man. He respects the judiciary and its decisions, a clean man who could say no wrong," he said.

"Mubarak has seriously and faithfully worked to the best of his abilities and energy for Egypt and its people, lived a life burdened by his nation's problems," he said. "For that, he is worthy of justice and no one should discredit his efforts, question his loyalty or history."

The victims' lawyers were again enraged when Salwah al-Soubi, a member of the defense team, chanted "Mubarak, we love you!" in addressing the ousted leader in the defendants' cage.

"Sit down and shut up!" shouted some of the lawyers for the victims.

Outside the trial venue, some 300 hundred Mubarak supporters chanted slogans in support of the former president. They came close to fighting with about 100 relatives of the victims, but riot police intervened and separated the two camps.
